Should you register a
trademark or a
design mark?

Simply put, trademarks signal the origin of products to consumers and design marks specify how products look. So the decision to register a trademark or a design mark is based on what you want to protect. If you want to protect your logo, you will use a type of trademark called a figurative mark, or if you want to protect your name, you will use a word mark, and if you want to combine both, you will use a figurative mark containing word elements.

If you have products on the other hand, you will use a design mark, because it protects: “’The appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colours, shape, texture and/or materials of the product itself and/or its ornamentation’.”

Take action to protect your name today

Brand protection is like an insurance. We insure our cars and other valuable possessions against theft, and that is exactly what you are doing by protecting your name, logo and other designs you might create.

Once they are protected, you are the only one who can use them, and if someone else tries to use your name, you are legally covered to prevent them from doing so.
